The First Amendment guaranteeing the right to free speech is apparently of little interest to Senator Barack Obama, the Democratic presidential nominee. The Obama campaign believes dissenting views on political advertisements can be redressed, or at least frightened into submission, through legal recourse.

The only conceivable purpose of Messrs. McCulloch, Obama and the others is to frighten people away from expressing themselves, to chill free and open debate, to suppress support and donations to conservative organizations targeted by this anti-civil rights, to strangle criticism of Mr. Obama, to suppress ads about his support of higher taxes, and to choke out criticism on television, radio, the Internet, blogs, e-mail and daily conversation about the election.

On Tuesday (September 23), CBS affiliate KMOV reported that Obama had enlisted a number of Missouri law enforcement officials, including local sheriffs and prosecutors, “to target anyone who lies or runs a misleading television ad [against Obama] during the presidential campaign.”

A team of Obama-supporting prosecutors and sheriffs in Missouri is preparing to pursue legal challenges to any presidential campaign ads deemed to be false or misleading.
“If they’re not going to tell the truth, somebody’s got to step up and say, ‘That’s not the truth. This is the truth.'”
The effort appeared to be part of a move by the Obama campaign to block advertisements to which it objects. The campaign also sent “threatening” letters to several news agencies in Pennsylvania and Ohio demanding they stop airing ads exposing Obama’s gun stance, according to the National Rifle Association.

“NRA-PVF has the facts on our side. No amount of running from or lying about his record and then intimidating news outlets in the hope of deceiving American gun owners and hunters is going to work. Those strong arm tactics may work in Chicago, but not in Pennsylvania and Ohio, and not as long as NRA-PVF has anything to say about it.”

American Issues Project’s DOJ Confirms It Has No Plans to Investigate Donors and Independent Citizens Groups. The Obama campaign complained to the Department of Justice to pursue investigation of independent groups’ opinions on the current presidential race. September 16, 2008.
In response to the American Issues Project’s ad examining the links between Sen. Obama and unrepentant domestic terrorist William Ayers, the Obama campaign has demanded three times in the past month that the Department of Justice investigate and prosecute the American Issues Project, its officers, board of directors, and donors for supposed campaign finance law violations.
Ed Martin, president of the American Issues Project, responded to the report: “The American Issues Projects applauds the Department of Justice for refusing to treat as criminal the exercise of free speech during an election. The Obama campaign’s tactics have been recognized for what they are – an attempt to bully a legitimate message off the air through intimidation and scare tactics.”

Needless to say, no one actually has to be prosecuted for this to work. Prosecution will be impossible anyway in most cases thanks to the First Amendment. The point isn’t to jail critics but merely to price the cost of prospective litigation into their decision on whether to publicly criticize The One.
Oh, the fun we’ll have with a deep blue Congress and an Obama-run DOJ and FCC. He promised you a “new type of politics,” didn’t he?

Slander and libel are civil offenses, so why would a prosecutor be involved in the first place.
But, maybe there is something to this and some local yokels are trying to discourage Obama bashing by raising the cost of gainsaying his Logosness? Even if it is all a bunch of bologney since the average schmo is pretty intimidated by the threat of a lawsuit.
Along similar lines, September 27, 2008, Michelle Malkin’s More Obama gangland tactics: Signs banned at Virginia rally today and The Free Lance-Star in Fredericksburg Signs of Liberty, report on an Obama public rally, held on the public property of the University of Mary Washington in Virginia, prohibiting signs and banners.
A UMW spokeswoman says that the Obama campaign required the sign-and-banner ban. That campaign tells us that the ban is for “security” reasons. But a spokesman for the U.S. Secret Service, responsible for protecting presidential candidates, says that the service has no objection to signs at rallies, provided that no “part of the sign could be used as a weapon”–e.g., a heavy metal pole or a sharpened stick. Finally, the McCain campaign tells us, “We encourage people to make signs at our events.”
An opinion printed in Magic Marker should never be contraband at an open American political event–and if that emblazoned thought interferes with the atmospherics of some partisan stagecraft specialist, that is a bearable tragedy.
Malkin reminds us of Obama’s previous attempts to silence free speech as well.
